Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the sCloud dashboard and services. By using our panel, you agree to these Terms.

Acceptance of Terms

By creating an account or accessing the dashboard, you confirm that you are able to enter into a binding agreement and that you accept these Terms. If you are using the services on behalf of an organization, you represent that you have authority to bind that organization.

Use of Service

The panel enables you to configure and manage hosting and CDN features, including domains, storage buckets, delivery settings, and related resources. You agree to use the services only for lawful purposes and in accordance with applicable policies.

  • Do not disrupt or attempt to compromise the integrity of the platform.
  • Avoid usage that violates applicable laws or third-party rights.
  • Follow fair use limits, rate limits, and technical constraints.

User Responsibilities

  • Keep account credentials confidential and secure.
  • Ensure your configurations and content comply with applicable laws.
  • Maintain accurate billing information, where applicable.
  • Promptly notify us of suspected unauthorized access.

Payments & Merchant of Record (Polar)

sCloud uses Polar as our payments platform and Merchant of Record (MoR). When you purchase or subscribe to sCloud services, the transaction is processed by Polar, who issues receipts/invoices and, where required, collects and remits applicable taxes (e.g., VAT/GST). You may see Polar (or its affiliates) listed as the seller on your receipt or bank statement.

  • Checkout, billing and invoicing are handled by Polar on our behalf.
  • Refunds, adjustments, and chargebacks are administered through Polar.
  • We remain responsible for delivering and supporting the sCloud service.

Subscriptions, Billing & Refunds

Subscriptions renew automatically unless cancelled prior to the renewal date. You can manage or cancel your subscription from your account. Refund eligibility follows Polar's payment and refund handling; statutory rights in your jurisdiction may apply. If a payment fails or is disputed, access to paid features may be suspended until resolved.

Taxes & Invoices

Polar calculates, collects, and remits applicable sales taxes (including VAT/GST) where required by law. Invoices and receipts are issued by Polar as Merchant of Record and are valid for tax purposes where applicable.

Disputes & Chargebacks

If you believe a charge is in error, contact us first so we can help. Disputes and chargebacks are processed by Polar according to their procedures. We may suspend service for unresolved or fraudulent payment activity.

Supported Countries & Availability

Payment availability and payout capabilities depend on Polar's supported countries and payment methods. Some features may not be available in your region due to payment or compliance restrictions.

Third‑Party Terms

Your purchase relationship for billing is with Polar as Merchant of Record and is subject to Polar's terms and policies in addition to these Terms. Using sCloud constitutes acceptance of any such third‑party terms that apply to billing and payments handled by Polar.

Intellectual Property

All platform software, documentation, and branding are owned by sCloud or its licensors and are protected by intellectual property laws. You retain ownership of your content. You grant sCloud a limited license to process your content solely to operate the services.

Limitation of Liability

To the maximum extent permitted by law, sCloud is not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or use, arising from or related to your use of the services.

Termination of Service

We may suspend or terminate access to the services if you materially breach these Terms, if required by law, or to protect the platform and its users. You may stop using the services at any time.

Governing Law

These Terms are governed by the laws of Belgium and applicable EU law, without regard to conflict of laws principles. Courts located in Belgium will have exclusive jurisdiction, unless otherwise required by mandatory law.
