Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the sCloud platform, including the dashboard, APIs, CDN services, storage services, and related infrastructure (the "Services").

sCloud is an independent software service operated by Lucas Guiot.

By accessing or using the Services, you agree to be bound by these Terms.

2. Eligibility

You must be at least 18 years old to use the Services.

By creating an account or using the Services, you confirm that:

  • you are legally able to enter into a binding agreement
  • you will comply with these Terms and applicable laws

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization.

3. Account Registration

To access certain features of the Services, you may be required to create an account.

You are responsible for:

  • maintaining the confidentiality of your account credentials
  • all activities that occur under your account
  • promptly notifying us of unauthorized access or security issues

We reserve the right to suspend accounts that compromise the security or integrity of the platform.

4. Description of Services

sCloud provides developer infrastructure services, including but not limited to:

  • Content Delivery Network (CDN)
  • Object storage
  • APIs and data services
  • logging and analytics tools
  • related infrastructure features

We may modify, update, or discontinue parts of the Services at any time.

5. Acceptable Use

You agree not to use the Services for any illegal, harmful, or abusive activity.

Prohibited uses include, but are not limited to:

  • distributing malware, ransomware, or malicious code
  • hosting or distributing stolen or pirated content
  • phishing, fraud, or deceptive practices
  • operating botnets or launching network attacks
  • violating intellectual property rights
  • distributing illegal content under applicable law

We reserve the right to investigate and remove content that violates these rules.

6. User Content

You retain ownership of any content you upload, store, or distribute using the Services.

By using the Services, you grant sCloud a limited license to process, store, and deliver your content solely for the purpose of operating the Services.

You are solely responsible for:

  • the legality of your content
  • obtaining necessary rights and permissions
  • compliance with applicable laws

sCloud does not actively monitor user content but may review or remove content if:

  • required by law
  • reported as illegal
  • necessary to protect the platform or users

7. Fair Use Policy

Use of the Services is subject to the sCloud Fair Use Policy.

Extremely excessive usage, abuse of infrastructure, or usage that negatively impacts platform stability may result in limitations or suspension.

8. Payments and Merchant of Record

Payments for sCloud services are processed by Polar.sh, which acts as Merchant of Record.

As a result:

  • Polar handles billing, invoicing, and tax collection
  • invoices may list Polar as the seller of record
  • refunds and chargebacks are processed through Polar

sCloud remains responsible for providing and maintaining the Services.

9. Subscriptions and Billing

Subscriptions renew automatically on a monthly basis unless cancelled before the renewal date.

You may cancel your subscription through your account dashboard.

Refunds are generally not provided except in cases of accidental purchases where the service has not been used and the request is made shortly after the transaction.

Failed payments or chargebacks may result in suspension of paid features.

10. Data Retention and Deletion

If an account is terminated or a subscription ends:

  • user data may be retained for up to 30 days for recovery purposes
  • during this period, the data may not be accessible through the dashboard
  • after 30 days, data and backups are permanently deleted

Users are responsible for maintaining their own backups.

sCloud is not responsible for data loss.

11. Service Availability

The Services are provided on an "as is" and "as available" basis.

We do not guarantee uninterrupted availability, uptime, or performance.

Maintenance, infrastructure failures, or third-party dependencies may cause temporary interruptions.

12. Suspension and Termination

We may suspend or terminate access to the Services without notice if:

  • these Terms are violated
  • abusive or harmful activity is detected
  • payment issues occur
  • required by law
  • necessary to protect the platform or users

You may stop using the Services at any time.

13. Intellectual Property

All platform software, documentation, and branding related to sCloud are owned by sCloud or its licensors and are protected by intellectual property laws.

These Terms do not grant you ownership of the platform itself.

14. Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided without warranties of any kind, whether express or implied.

This includes, but is not limited to:

  • merchantability
  • fitness for a particular purpose
  • non-infringement

15. Limitation of Liability

To the maximum extent permitted by law, sCloud will not be liable for:

  • indirect damages
  • loss of profits
  • loss of revenue
  • loss of data
  • business interruption

In all cases, the total liability of sCloud arising from or related to the Services will not exceed the total amount paid by you for the Services during the 12 months preceding the claim.

16. Changes to the Services or Terms

We may modify the Services or these Terms at any time.

If significant changes are made, we may notify users through the dashboard or other communication channels.

Continued use of the Services after changes constitutes acceptance of the updated Terms.

17. Governing Law

These Terms are governed by the laws of Belgium and applicable European Union law, without regard to conflict of law principles.

Any disputes shall fall under the jurisdiction of the competent courts of Belgium unless otherwise required by mandatory law.
